Ark Valley Electric Cooperative , Inc. Surge Protection Lease Agreement

THIS AGREEMENT is made between ARK VALLEY ELECTRIC COOPERATIVE ASSOCIATION, INC., ("Coop") and the undersigned Member(s). The Member ("You"), acknowledge that you understand and agree to abide by the terms of this Agreement for a minimum of two (2) years. After the initial two year period, this Agreement shall automatically be renewed on a month-to-month basis until terminated by either the Coop or by You. This Agreement pertains to a Meter Base Surge Suppression Device (MB-SSD). Prior to the installation of the MB-SSD, the Coop's representative will inspect the external grounding system for the residence to verify that a proper external safety ground exists at the service entrance. If the Coop's representative should determine that any of the home's electrical grounding system or wiring are inadequate for the proper installation of the SSD, the Coop reserves the right to refuse installation until the corrections are made. You will be supplied with a plug-in SSD kit at the time of the MB-SSD installation. It is your responsibility to see that the plug-in SSD's are properly installed in accordance with the installation guide, provided in the kit, in order to validate the warranty. You will be charged an installation charge of $25.00. You will be billed a monthly charge on your regular monthly electric bill in the amount of $5.99 plus sales tax which shall be considered due upon the same date as your electric billing. A late charge of 2% will be applied to delinquent payments. If you move to another home within the Coop's service area, prior to expiration of the minimum term, you may transfer the protection services for the remaining period of the Agreement to the new home. If you move to a home outside the Coop's service area, you may cancel this Agreement without penalty. If you elect to discontinue services for any reason prior to the expiration of the minimum term of this Agreement, you will be responsible for the monthly payments for the remaining portion of the term. Upon disconnection for any reason, you will be responsible for a disconnect fee of $25.00. The Coop makes no express warranties and all express warranties provided for the MB-SSD and the plug-in SSD kit, are the warranties of the manufacturer.
